MiCA in one paragraph
MiCA — the Markets in Crypto-Assets Regulation (Regulation (EU) 2023/1114) — is the EU's first comprehensive legal framework for crypto-assets and crypto-asset service providers (CASPs). The stablecoin rules (Titles III & IV) came into force on 30 June 2024, and the CASP rules (Title V) on 30 December 2024. From that point forward, only MiCAR-licensed entities can legally provide crypto-asset services to EEA residents.
What MiCA means for affiliates
If you promote crypto services to an EEA audience — via ads, YouTube, X, Telegram, newsletters or a website — MiCAR shapes what you can say and who you can send that audience to. Practically, that means three things for affiliates:
- Promote only MiCAR-licensed entities to EEA users. For Bybit, that's Bybit.eu — not Bybit.com.
- Marketing communications must be fair, clear and not misleading, with prominent risk warnings for crypto-assets.
- Avoid claims about returns, "guaranteed" outcomes, or tokens/products that aren't in-scope of the promoted CASP's authorisation.
Bybit & MiCA
Bybit EU GmbH (Vienna, Austria) is MiCAR-licensed. EEA-targeted campaigns should apply to the Bybit.eu Affiliate Program.
Bybit.com is operated outside the EU and is not licensed under MiCA. It is not available to EEA residents. Non-EU traffic goes into the Bybit.com Affiliate Program.
